State and private enforcement officers of Chernihiv region strengthen their capacity in the field of enforcement of court decisions

A training for state and private enforcement officers was held in Chernihiv on the topic: “Enforcement of decisions: modern experience and best practices.”

The purpose of the event was to raise awareness among enforcement officers about changes in the legislation on the enforcement of court decisions, provide practical advice on the effective organization of enforcement of decisions, and raise awareness among participants about the requirements of modern anti-corruption legislation, which applies to both state and private enforcement officers.

“A significant problem in the country today is the non-enforcement of court decisions; the current legislation is constantly changing. Thus, the Law of Ukraine “On Enforcement Proceedings” adopted in 2016 has already undergone several significant changes. Therefore, it is very important to discuss the state of the legislation on enforcement proceedings with those people who directly work with this every day, that is, with state and private enforcement officers,” the human rights activist emphasized.

“Today, the institute of private enforcement officers has been introduced, which is a new experience for Ukraine. At the same time, such an institute operates in many countries of the world. It is no secret that today the enforcement of decisions is a little “sluggish”. But we all understand that the enforcement of decisions is a very important component of the justice system”, – the expert emphasized.

“It is too early to talk about the effectiveness of the institute of private enforcement officers, because such an institute has only been operating for a year. Today, about 118 private enforcement officers are registered in Ukraine, but for Ukraine this is “meager”. Practice shows that private enforcement officers are more focused on the actual enforcement of decisions. Their practice proves that this is the right position regarding the introduction of this institute and the level of enforcement they observe is better than that of the state enforcement service”, – noted

During the training, the participants discussed the legislation regulating the procedure for enforcement proceedings, in particular, practical aspects of opening and costs of enforcement proceedings, collection of enforcement fees. Special attention was paid to obtaining information about the debtor, tracing the debtor and identifying his assets. The event was concluded with practical aspects of foreclosure on the debtor’s property (funds), valuation of the debtor’s property and its implementation.


The training was organized by the All-Ukrainian Coalition for Legal Aid and the Chernihiv Public Committee for the Protection of Human Rights within the framework of the implementation of the all-Ukrainian project “Effective execution of court decisions – the key to the successful completion of judicial reform” with the support of the Ministry of Foreign Affairs of the Kingdom of the Netherlands and with the assistance of the Department of the State Enforcement Service of the Ministry of Justice of Ukraine.
