FREEDOM OF MOVEMENT


According to lawyer Vyacheslav Yakubenko, who represented this case in court: “No one disputes the good intentions of the deputies: to overcome juvenile delinquency and child alcoholism in the region. But this is not a basis for

violating the constitutional right of citizens to freedom of movement. After all, according to Article 2 of the Law of Ukraine “On Freedom of Movement and Free Choice of Residence in Ukraine”, restrictions on freedom of movement can only be established by law, and not by decision of regional, district or village councils. The same provisions are contained in Article 12 of the International Covenant on Civil and Political Rights and in Article 2 of Protocol No. 4 to the European Convention for the Protection of Human Rights and Fundamental Freedoms.
