PROVIDING LEGAL ASSISTANCE TO CITIZENS


The best assistant in this situation can be lawyers: the help of these specialists often allows not only to protect the rights provided for by law, but also to get more. At least in civil cases, where the main principle is the adversarial nature of the parties.


However, the cost of lawyers’ services is significant, for orientation we provide some prices from one of the law firms in Chernihiv. Regarding which it is noted that these prices are average in the city.


Oral consultations – from 20 UAH. (But we note that the usual cost of legal consultations in the city is 50 UAH.).


Written consultations – from 100 UAH.


Analysis of contracts and other documents – from 100 UAH.


Drafting a simple claim (alimony, divorce) – from 100 UAH.


Drafting other claims – from 300 UAH.


Drafting an application to the European Court – from 500 UAH.


Conducting cases in civil court – 2500 UAH. plus 500 UAH for the second and each subsequent day in court.


Criminal cases (including participation in a judicial investigation) – 4000 UAH. plus 500 UAH. for each day of participation in court sessions.


When a person does not have such funds, then in accordance with international agreements in the field of human rights, the state must provide him with the necessary legal assistance. This is implemented in the new Law, according to which the state must provide free primary legal assistance. Which includes:



1) providing legal information;



2) providing consultations and explanations on legal issues;



3) drawing up

applications, complaints and other

documents

of a legal nature (except procedural documents).






Such legal services as drafting claims, representation in court, etc., are secondary legal aid. The state will provide such assistance free of charge only to certain categories of persons on the principle of “pro bono”. That is, when assistance is provided by lawyers, and the state pays for their services.


Everyone can receive free primary legal aid; for this, in accordance with Article 10 of the Law, one must apply with a written or oral application to central or local authorities, local self-government bodies in accordance with their competence. Legal information on such an application must be provided within 15 days, other primary legal aid – within a month.
