Representatives of the Ombudsman found violations in the activities of the Chernihiv region police

On May 16-17, 2013, employees of the Department for the Implementation of the National Preventive Mechanism of the Secretariat of the Verkhovna Rada of Ukraine Commissioner for Human Rights, together with representatives of the NGO “Association of Ukrainian Monitors of Human Rights in the Activities of Law Enforcement Agencies” and the regional representative of the Commissioner Viktor Tarasov, visited bodies and units subordinate to the Regional Department of the Ministry of Internal Affairs of Ukraine in Chernihiv region.
This was reported by the press service of the Verkhovna Rada of Ukraine Commissioner for Human Rights.
The visits were carried out with the participation of employees of the Prosecutor’s Office of Chernihiv region. During the visits, the state of human rights observance in the activities of the visited units and the implementation of the recommendations of the Commissioner for Human Rights provided to the leadership of the Ministry of Internal Affairs of Ukraine based on the results of visits to internal affairs bodies in other regions were studied.
Thus, the Kozeletsk and Nosiv regional departments, temporary detention centers of the Kozeletsk and Chernihiv regional departments, and the Chernihiv city department were visited. The monitoring results show that despite the Commissioner’s constant recommendations to the leadership of the Ministry of Internal Affairs of Ukraine based on the results of visits to internal affairs bodies in other regions, these recommendations are not being implemented in the Chernihiv region. The same shortcomings and violations were found that are inherent in almost all previously visited city and district bodies, namely:
– the right of detained persons to receive free legal aid is not ensured, unreliable information about the time of detention of these persons is entered into the relevant journals;
– there are massive violations of regulatory requirements for fingerprinting of various categories of persons;
– there is no proper accounting of persons who are detained and delivered to city and district bodies by patrol service employees;
– unsatisfactory accounting of persons who are in the premises of internal affairs bodies and units;
– unsatisfactory accounting of removals from cells of temporary detention centers for detained and detained persons.
The conditions of detention of detained and detained persons in the rooms of detained and delivered to the duty unit and temporary detention centers do not fully comply with national and international standards.
In addition, in Kozeletsk Regional Administrative District, on the information stand of the State Enterprise of the Ministry of Internal Affairs “Resources – Documents”, information was found posted in 2008 under the heading “Be vigilant!” regarding the prevalence of fraud in the district, in which hate speech is used.
As a positive impression, it is worth noting the proper general sanitary condition of the premises of both visited temporary detention centers and the proper maintenance of documentation in these institutions, as provided for by relevant regulatory legal acts.
The Secretariat of the Verkhovna Rada of Ukraine Commissioner for Human Rights is preparing appropriate response acts for the identified shortcomings and violations.
