The state owes 37 million hryvnias to Chernihiv “children of war”

Tens of thousands of residents of Chernihiv region over the age of 67 are waiting for the bailiff service to execute the court decisions to recover in their favor the amounts of pension supplements from persons who have the social status of “children of war”. The total amount as of March 1, 2013, which they should receive is UAH 37,406,105.52.
According to Ukrainian legislation, the state bailiff service is obliged to execute court decisions within six months. During this time, state bailiffs are obliged to impose arrests on the debtor’s accounts and property and collect the amount of debt established by the court. But in relation to the Pension Fund, the bailiff service does nothing of the kind and does not intend to do so. And the PFU itself only included the people for whom writs of execution were received in additional information, and is waiting for the budget of Ukraine to allocate funds for payments based on this information. As a result, many Chernihiv pensioners have been waiting for the execution of court decisions since September 2011.
In the Chernihiv Public Committee for the Protection of Human Rights, a significant part of the clients are still “children of war”. And the absolute majority of them apply for the execution of court decisions. Unfortunately, many will not wait for this. For example, an elderly couple, having received copies of court decisions, did not guess that after that they still need to get a writ of execution. And now the court refuses to issue them a writ of execution – due to missing the deadline for presenting the writ of execution (1 year from the date the court decision enters into legal force). Someone’s writ of execution was lost during shipping, and enforcement proceedings will not be opened either. Although the main reason, of course, is different. The situation is unacceptable not only from a legal but also from a moral point of view: the mortality rate of people over the age of 67 exceeds 10% per year. And during the time that the decisions made by the courts are not being implemented, the state has already saved several million hryvnias in the Chernihiv region alone. After all, some of the people who were supposed to receive money under these decisions are, unfortunately, no longer alive.
