Training for judges and asylum officers on migrant and refugee rights

On 16 June 2014, the Chernihiv Public Committee of Human Rights Protection and the United Nations High Commissioner for Refugees Regional Representation for Ukraine jointly with the Higher Administrative Court of Ukraine held seminars for Zakarpattya asylum officers and judges who specialize in disputes concerning the status of refugees and persons in need of complementary protection, forcible return and expulsion of foreigners or stateless persons from Ukraine, as well as disputes related to the stay of foreigners and stateless persons in Ukraine.

The seminars were organized in Uzhgorod for judges of the Lviv Administrative Court of Appeal and the Transcarpathian Regional Administrative Court, Mukachevo and Uzhgorod city district courts in the Transcarpathian region and Transcarpathian migration service officers, with the financial support of the Human Rights Fund of the Embassy of the Kingdom of the Netherlands in Ukraine.

The purpose of the events was to raise the judges’ awareness of: positive practice of disputes regarding the status of refugees and persons in need of complementary protection by administrative courts of Ukraine; proper use of COI; recent alterations in the definition of “person in need of complementary or temporary protection as specified in the article 1 of the Law of Ukraine “On Refugees and Persons in Need of Complementary and Temporary Protection”, appropriate precedents made by the ECHR to prevent from forcible return and expulsion of asylum seekers and other categories of migrants from Ukraine.

Special attention was paid to the problems of access to international protection procedure in Ukraine and vulnerability of UAMs, pregnant women and stateless persons in the face of forcible expulsion from Ukraine due to the lack of: high-quality translation and free legal assistant during appropriate procedures and court hearings. The lawyers shared with the judges their experiences in representing such vulnerable groups in forcible expulsion cases.

The UNHCR represented the UNHCR International Protection Considerations with regard to people fleeing the Syrian Arab Republic dated 22 October 2013 and responded to numerous questions related to the above issue.

The UNHCR also shared their experience in working with IDPs in Ukraine.
